RETURNS POLICY

If you wish to return items purchased please note that:

  1. Goods must be in a saleable condition, unopened, uncut and in the same condition as purchased.
  2. Goods must be returned within 1 month of purchase.
  3. Full name and telephone number of person returning goods must be provided. (This is required by SARS)
  4. We cannot credit items specially planed, manufactured or cut.
  5. If requested to collect goods a transport fee may apply.
  6. A copy of the invoice must be provided.
  7. A handling charge may apply. (see below)

Payment of refund:

  1. A 10% handling charge will be charged on all actual payments back to a customer.
  2. No handling charge will apply on defective goods or goods supplied incorrectly by ourselves.
  3. No handling charge will apply if other goods are purchased – a 10% handling will only be charged on the actual amount refunded
  4. Clear banking details must be provided in writing – all refunds are done via Electronic Funds Transfer.
  5. Refund payments will be processed in 5 working days.

 

CONDITIONS OF SALE

Any order, after given to Somerset Timbers, will constitute an irrevocable Offer to Purchase and, on acceptance by Somerset Timbers, will become a valid purchase, subject to the following conditions of sale:

  1. Ownership of all goods delivered remains vested in Somerset Timbers until full payment is made to Somerset Timbers. In the event of failure by the client to make full payment, the client hereby authorises Somerset Timbers to remove and retain the goods until full payment.
  2. Delivery times where stated are solely business estimates.
  3. Any defects must be notified to the Company by a responsible employee at the time of delivery, otherwise the Company will not hold itself responsible for such damage.
  4. Subject to paragraph one above the Company shall not be responsible for any defect whether latent or patent save as may be expressly stipulated by the Company for individual products, and defects will only be rectified in terms of these guarantees. Should, however, the customer, or the customer’s servants or agents, attempt to repair, or in any way tamper with the goods, or should it appear that the defect was caused either wholly or in part by any abnormal or unreasonable use we shall not be obliged in any way to make good such defect and the customer shall reimburse us for any expense incurred in sending workmen to inspect and/or repair or replace the faulty article.
  5. We shall not be liable for, and the customer hereby indemnifies us against any loss or damage (whether direct or consequential) suffered by the customer and/or third parties arising out of any defects in the goods sold in consequence hereof, or in respect of incorrect or faulty work performed and our liability shall be limited strictly to our undertakings herein contained.
  6. The customer shall not be entitled, in any circumstances on the grounds of any complaint, or dissatisfaction in the goods sold to hold back the whole or any portion of the price thereof, but shall be obliged to effect full payment thereof on due date for payment, but we shall, however, without prejudice be entitled in our sole discretion to agree to a reasonable retention for such period and on such conditions as we in our sole discretion may determine.
  7. The price of the goods is based on the cost of material and labour as at the time of acceptance of the order. Any increase in the cost of material and/or labour prior to delivery shall entitle us to charge such increase to the customer. If due to unforeseen circumstances the contractor cannot proceed with construction or work and as a result thereof delivery is delayed, Somerset Timbers may, at their discretion, apply an escalation in price of the goods, should there be an escalation in the price of the products.
  8. Where the goods have been supplied in terms of any drawings or specifications, we shall not in any way be responsible for any loss or injury resulting from such goods being inadequate or unsuitable for the purpose required.
  9. No addition, alterations to, or variation, of these terms shall be binding unless we have agreed thereto in writing.
  10. Payment of the amount due in terms of your order shall be effected in full on the 30th day of the month following that in which delivery or installation is effected unless otherwise agreed to in writing and ownership of any goods sold shall only pass to the customer on payment of the full purchase price and not on delivery. Payment shall be effected on due date. This applies to approved account holders only.
  11. In the event of payment not being made on due date then without prejudice to any other rights or remedies which we may enjoy in the circumstances we shall have the right at our option to cancel the sale and to retake possession of the goods sold and to claim such other damage as we may have suffered.
  12. The Company shall not be liable in respect of any colour and/or size discrepancies in batches of the same article.
  13. Catalogues, illustrations and perspective drawings are approximate and furnished for information purposes only.
  14. In the event of the client breaching the terms of this agreement, Somerset Timbers shall be entitled to either:

(i)  cancel the agreement, in which event the client shall forfeit all such monies as have been paid to Somerset Timbers at that stage and may claim such damages as they may suffer in addition hereto;

  • proceed with the contract in which event the full contract price will immediately become due and payable, together with interest
  1. Interest on overdue accounts will be charged at three percent above the commercial bank prime overdraft rate prevailing.
